Hi,

Four years after my submission, CHU Insurance finally found that at least $8,800.00 now has to be repaid from owners corporation to them for alleged legal claim that my strata plan SP52958 made in 2012/2013.

It is now very clear that BCS Strata Management in this complex made four premeditated insurance claims in amount of:

$367.64 on 31 August 2012

$12,714.65 on 7 December 2012

$1,320.00 on 26 April 2013

$10.517.02 on 4 June 2013

BCS Strata Management, without official approval or knowledge of owners corporation, changed the insurance policy and then started making first claim ONE WEEK AFTER THE POLICY CHANGE!

We enclose herewith brief analysis of why we strongly stand with statement that these insurance claims were premeditated, carefully organised with intention to defraud insurance company, and based on alleged "legal defence of Lot 3" in CTTT that does not exist in regards to this owner (who happens to be a long-serving member of the Executive Committee, and current Secretary of the Executive Committee).

Whilst CTTT cases against mismanagement of the complex were initiated (and sadly dismissed in spite of around 3,000 pages of evidence which CTTT ignored), they were not related to "Lot 3"! we now have collected plenty of evidence and some extract are in the document.

BCS Strata Management silence and refusal to act in accordance with SSMA 1996/2015 and other laws of the land speak for themselves. Attempts to Mediate at Department of Fair Trading were rejected four times, CTTT cases went nowhere due to misleading, misconceived, and deliberately withheld statements by BCS and refusal to provide access to strata documents (in non-compliance with SSMA 1996 S108).

During investigation of complex mismanagement, they silently ignored all information about six attacks on us:

Anonymous hate email in letterbox. Police Event on 7 October 2011.

EC member’s attempt to bully female owner in garage in 20 October 2011.

Anonymous phone death threat sometime in 2012. Reported it to Minister of NSW Department of Fair Trading in 2013.

EC member’s attempt to bully female owner at petrol station in August 2015.

EC member's verbal attack and light assault on female owner in October 2015.

Police Event against EC member and BCS Strata Management in November 2015.

We politely ask you, for the sake of future increases in insurance premiums, that you verify this report, which four years after we had originally reported, started making sense...
