Dear City of Ryde Council and Fire Services,

1) Three general meetings occurred since my last report and none of them had any information for owners about fire safety orders and continuous delays strata manager, building manager and committee members cause:

The delays are not coincidental. They are deliberate, premeditated, and designed to avoid compliance with fire safety. One of the reasons for their delays is lack of proper financial planning (as of today, Admin Fund has negative balance (deficit) in amount of $190,700.41).

2) At Annual General Meeting on 26 October 2023, a committee member, Mrs. Marianna Paltikian, publicly voiced concerns why this complex should spend money on fire safety.

3)  At Extraordinary General Meeting on 22 February 2024, committee member Mr. Stan Pogorelsky also voiced the same concerns, lamenting the need to implement fire safety remediation works, stating that some of the regulations did not exist 34 years ago! 

4) On 13 February 2024, through two NSW Fair Trading cases, I finally obtained access to some strata documents, including evidence of Council fire orders and show cause orders.

My document search uncovered that, at least in 2022, Mr. Simon Wicks was assigned to SP52948 fire safety project, without owners corporation knowledge.

Mr. Wicks was actually removed from managing this complex two times - due to poor performance and misconduct whilst working as strata manager for BCS Strata Management and later whilst working as strata manager for Waratah Strata Management.

5) Apart from major issues, which City of Ryde and NSW Rural Fire Services are still waiting for a resolution for several years, even smaller fire safety problems are a huge problem and here are just few of easily-visible items neglected by Uniqueco Property Services, Waratah Strata Management, and committee members, deliberately risking lives and property:

That is directly confirmed by the email on 30 November 2020.

6) Email from Uniqueco Property Services to Waratah Strata Management on 4 February 2021 shows their determination to ignore fire safety UNLESS they are forced to do it.

7)  As of today, 27 March 2024, Waratah Strata Management on their website lists 16 open orders for various rectification works, of which seven are related to fire safety:

Hello

Council has issued the order and a show cause order – if you are an owner you can request these from your Strata Manager.

Council has also received a satisfactory AFSS this year a copy was also sent to  fire & rescue.

Problems within the building and outstanding issues should be followed up with your strata manager or owners corporation.
