PROBLEM: SP52948 examples of non-compliance with Special By-Law 14 for animals as of 29Jul2021
Problems with small dogs:
Reported to Waratah Strata Management on 19 April 2021 - no response received.
"At around 09:45 hours today, small dog in company of a parent and a girl from level 4 in Block A were witnessed walking through basement and near elevator in Block A. The dog was on a leash and walking.
Dog was not carried.
When they approached the elevator, we kindly advised them about non-compliance with the regulations. The girl promptly took the dog into her hands and carried it into the elevator.
First breach by the tenant.
In this specific case it appears that:
a) Tenants were not aware of current By-Laws in the complex, which they should have received immediately after they were updated.
Lodgement of changes to By-Laws is done by a Consolidation/Change of By-Laws form. Tenants must be notified of any change in By-Laws promptly.
b) By talking to other tenants in SP52948, none of them appear to have received latest By-Laws.
c) Tenants in townhouse have also been observed and witnessed number of times with a small dog without a leash on common property inside the complex."

Tenant from level 4 in Block A on 1 July 2021 at 16:32 hours:
Basement of Block A.
Father and young daughter entered elevator with little dog on a leash and walking.
Dog was not carried.
CCTV recording has proof of breach of Special By-Law 14.
Second breach by the same tenant.
Same tenant from level 4 in Block A on 21 July 2021 at around 16:10 hours:
Whilst collecting photos of garden bed neglect, witnessed loud dog barking from upper floor balcony in Block A.
Third breach by the same tenant.
Same tenant from level 4 in Block A on 27 July 2021 at around 16:02 hours:
Mother and daughter left elevator on ground floor of Block A with small dog on leash, freely walking (not being carried).
They walked through foyer towards exit of the building, where the dog tried to apprach owner from Lot 158.
Owners corporation staff was in the office on ground floor at the time.

Fourth breach by the same tenant.
Same tenant from level 4 in Block A on 29 July 2021 at around 17:42 hours:
Lot 158 owner entered the building after tennis and was standing in front of elevator.
A couple of second later a young girl from level 4 in Block A entered the building with her small dog.
Dog was on leash and freely walking (not being carried).
Dog approached Lot 158 owner who turned around and very politely advised the little girl that Special By-Law required dog to be carried inside the buildings.
She complied immediately.
Lot 158 owner then said that they loved dogs but regulation was something that needed to be complied with.
Lot 158 allowed the young girl and her dog to enter the elevator, although Lot 158 arrived first.

Fifth breach by the same tenant.
