The response is unsatisfactory and seems to contain elements of some kind of threats?

Many questions were not answered or addressed.

Using legal help will be a very wrong decision for owners corporation, as it will show it is done to defend selective group of owners for their failures to act in accordance with the laws.

There is plenty of evidence to prove that EC, strata managers, and building managers only act to protect own interests. Not for the benefit of owners corporation.

1. Smoking near our balcony and bedrooms continued unabated. Owners corporation is responsible for health hazard to my family and me.

2. Lift problems. They do exist. We have more witnesses.

3. Video evidence has been collected from more units showing that ventilation is awful. In one unit, in one of the bathrooms even presence of unpleasant smells are detected.

4. Virtually unlimited number of repairs of water damages in units on top floor of Block A (at our expense).

5. The unsolicited push by some owners to "be friendly" with other owners and tenants exist even when those owners do not want to be approached. Maintenance staff knows about it.

6. We are paying for gas levies for a group of owners who have significant debt (including 10% simple interest per year).

7. Safety for our family is YOUR responsibility in equal manner as for any other tenant and owner.

and so on...

Please fix the issues, and there will be no need for communications. We certainly do not want to waste our time. Act in accordance with the laws and regulations.

As an example, for smoking, see that all ashtrays are removed near Fire Door 2, notice put on Fire Door 2 to warn against it, notice put on board in Block A and in lift, including the penalties (the same way notice was put about smoking problems in Block C this week). By not doing it in Block A, you are directly discriminating against owners in Block A and Lot 158 especially. That is one example of simple and immediate fix.

We provide the following responses to those issues we consider to be directly related to Lot 158.

Lot 158 Exhaust Fans – This has been responded to directly by maintenance staff .

Lot 158 use of the lift – Following is a response from maintenance staff advising Liftronic have investigated this issue and no fault with the lift has been found.

Stalking claim by Lot 158 against maintenance staff – You advise this has been reported to the police. Stalking is a criminal issue and should therefore be left in the hands of the police to deal with as they see fit. Waratah Strata and the Owners Corporation will therefore not get involved in this matter.

Hi Robert,

Regarding the lift, I have checked this several times over the past few weeks and found no fault. No other complaints have been bought to my attention from A Block residents.  

I called Liftronic out last week to check A Block lift and they found no faults present at time of testing. 

We did have an issue with B Block lift skipping levels several months ago. Liftronic were onsite to inspect and found that new parts were required. They sourced second hand parts due to the age of the lifts.

As you are aware, we are in the process of upgrading all 4 lifts and this will illuminate any future faults that may occur.
