Hi,

Concerns for Lot 158 levies being abused for private damages caused by others...

Repairs to front gate garage doors are every expensive and always occur as consequence of tenants or their visitors driving carelessly. Typical bottom panel itself easily costs around $3,000.00.

a) Provide evidence that Lot 108 repaid the full amount of $3,190.00 personally or via their insurance.

b) Provide evidence of who paid for similar damage to the bottom panel of the main garage door as reported by Lot 158 on 13 September 2018? The extract from Cash Payments for period 1 September 2018 to 2 May 2019 do not seem to contain such information (attachment "SP52948-garage-door-repairs-1Sep2018-to-2May2019.webp").

c) Two years ago, EC member Mrs. Paltikian personally admitted hitting the main gate and allegedly being forced by maintenance staff to repay several thousand dollars for the damage. Proof of such payment or recover of funds from her insurance was not found in any strata documents. Please provide it now.

d) How many other invoices does Waratah Strata Management avoid to pay on time, and how many invoices are lost? Since SP52948 does not have a Treasurer for 2019, who is overseeing the financials with full scrutiny?

History of recent event:

a) Lot 108 was responsible for damaging the bottom panel on the main garage door on 9 February 2019.

Allgate completed their work to repair it and charged owners corporation.

b) Invoice from Allgate was sent to Waratah Strata Management and maintenance staff on 29 April 2019.

Allgate was approved to repair the item via email from maintenance staff on 26 March 2019 (per Allgate quote No. A4133 dated 13 March 2019).

c) Document search on 31 May 2019 uncovered communication between Waratah Strata Management and maintenance staff, in which, it appeared they planned to stay silent and not pay the Allgate invoice they claimed not receiving.

Who, on behalf of Lot 158, and all other ethical and honest owners, approved that Waratah Strata Management and maintenance staff try to avoid paying for delivered services and prevent owners corporation to recover costs from an owner who damaged the bottom panel on the garage door?

Several problems with this statement:

1) It is unfair and brutal to try to avoid your company for services you provided. Everybody deserves to get paid for proper services.

2) Avoiding to pay for services make our strata complex SP52948 liable in case of litigation.

3) Not receiving an invoice (which was sent to Waratah Strata Management on time) is not an excuse for not taking care of the debt or not trying to settle it in a dignified manner.

4) Lot 108 is personally liable for the damage and strata manager needs to recover the losses once your invoice is provided.

d) In the Minutes of EC meeting on 20 June 2019, the issue of unpaid Allgate invoice was misconstrued and misrepresented to owners.
