Subject: OFFICIAL COMPLAINT SP52948 Smoking in basement area continues unabated on 23Dec2020

Good afternoon,

SP52948 By-Laws failure to be enforced.

It appears more than 20 complaints about smoking fell on deaf ears.

Smoking, as serious health, safety, and nuisance issue is not taken seriously enough.

For each of the previous and below listed incidents CCTV recording can confirm whereabouts of Lot 158 owners.

10 September 2020:
At around 12:10 hours, owner was going out of garage of Lot 158 and detected strong cigarette smell coming from from what appears to be a garage of a known offender. They were inside the garage at the time and came out with shopping bags.

16 October 2020:
Lot 158 owner passed by rubbish bins below Block A and sensed strong smell of cigarettes at around 12:29 hours. Known offender was in their garage opposite rubbish bins and loud coughing was heard at the time. Building manager staff already left the complex by that time and dashboard camera recording can confirm that they were not on site.
Both owners of Lot 158 walked from their garage to elevator in Block A and sensed strong smell of cigarettes around 13:27 hours. Known offender was in their garage opposite rubbish bins at the time.

2 November 2020:
Lot 158 owner passed by rubbish bins below Block A and sensed strong smell of cigarettes at around 17:55 hours. Known offender was in their garage opposite rubbish bins and loud coughing was heard at the time. Whilst Lot 158 was going towards garage, maintenance staff was passing on his scooter and going in general direction of Lot where known offender was.

7 November 2020:
Lot 158 owners passed by rubbish bins below Block A and sensed strong smell of cigarettes at around 17:58 hours. Known offender was in their garage opposite rubbish bins and loud coughing was heard at the time.

8 November 2020:
Lot 158 owner passed by rubbish bins below Block A and sensed strong smell of cigarettes at around 14:45 hours. The terrible smell was very obvious all the way to Lot 158 garage.
Known offender was in their garage opposite rubbish bins and loud coughing was heard at the time.

16 November 2020:
Female Lot 158 owner passed by rubbish bins below Block A and sensed strong smell of cigarettes at around 22:10 hours. The terrible smell was very obvious all the way to Lot 158 garage.
Known offender was in their garage opposite rubbish bins and loud coughing was heard at the time.

21 November 2020:
Two owners from Lot 158 owner passed by rubbish bins below Block A and sensed strong smell of cigarettes at around 18:00 hours. The terrible smell was very obvious all the way to Lot 158 garage. Known offender was in their garage opposite rubbish bins.

23 December 2020:

At 13:17 hours, Lot 158 owner had to go from garage to rubbish bins below Block A. Whole basement area around Block A smelled of strong cigarette smoke. Notorious smoker was in their garage at the time.

Two incidents of smoking near Block A, and repeated problems in Block B:

a) Today, at around 12:04 hours three members of Lot 158 went to garage area from level 2 by elevator. One of the owners went to garbage bins below Block A to recycle items. Strong smell of cigarettes was present. Well-known smoker was in their garage at the time.

b) Today, at around 13:09 hours three members of Lot 158 went to garage area from the ground floor by elevator. Strong smell of cigarettes was present all the way from the basement in front of elevator, near garbage bins, to Lot 158 garage. Well-known smoker was in their garage at the time.

CCTV recordings can confirm the travels.

c) Attachment "SP52948-notice-in-elevator-about-smoking-problems-on-balconies-Block-B-25Mar2020.webp" taken in Block B elevator shows the smoking problems are wide-spread.

Evidence has been collected that owners are not informed via notice boards or in the minutes of the meetings about repeated, persistent smoking issues and health risks.

For the last 10 years, depending on times of their employment with SP52948, BCS Strata Management, Waratah Strata Management, maintenance staff, and EC members failed to issue proper compliance notices for repeated offenders for smoking and failed to take serious actions, including financial penalties in accordance with By-Laws.
