Hi,

In accordance with SSMA 2015 Section 106 (Duty of owners corporation to maintain and repair property), and in compliance with Motion 19 at Annual General Meeting 2018 (strata affairs directly affecting Lot 158, which include financial losses and right to protect own investment), it is requested to officially respond why maintenance staff ignored to replant beautiful tree that is left dying as reported by Lot 158 on 23 December 2018, and ask for immediate action to resolve the problem.

a) The beautiful tree is owned by SP52948 and Lot 158 so it is a direct financial loss to let it die.

b) Replanting the tree would decrease significant risk of land erosion on steeply sloped area behind townhouses (photos clearly show how the soil has no top cover).

c) Replanting the tree helps (even in a small bit) to preserve the planet for future generations.

The tree is in danger of dying very quickly unless it is replanted immediately.

For several days now Lot 158 was monitoring the lack of action to remove uprooted tree and repair of the damaged fence towards Fontenoy Road (refer to attachments). As of this evening, nothing has been done yet, thus creating possibility of further damage to common property or humans walking outside the complex, for which Lot 158 certainly does not want to be responsible and does not allow any levies to be spent for possible litigation or insurance claims.

In addition, a beautiful but dying tree is left to die behind townhouses. Owners like me pay for the plants in the complex and no waste is funds should happen.

Lot 158 has been collecting evidence of several other overgrown trees over the fence towards Fontenoy Road, and unless they are properly pruned now, it is just a matter of time before they make some further damage.

We warned BCS Strata Management after similar event on 16 March 2015.

The ignorance by BCS Strata Management cost owners (including Lot 158) $3,450.00 (incl. GST) for removal of a large tree that fell into neighbouring townhose on 19 July 2015. This expense was kept secret from owners. SP52948 was very lucky that no human life was endangered at the time.

Please advise when the corrective actions will be taken in this regard.
