Subject: SUMMARY: SP52948 Request for agenda for next EC meeting - approve investigation by SCA Ethics Committee and other items 28Jun2013

Hello,

This email and the attachments are to be filed for owners in Strata Plan 52948 and dealt with at the next EC meeting.

In the meantime, as Strata Manager, and Treasurer, Secretary and the Chairperson of the Executive Committee since the AGM 2012, you are requested to include the following items on the agenda for the next EC meeting and report to me in person, or provide responses for all owners in the minutes:

1. Raine & Horne Strata Epping is a professional member of the Strata Community (NSW) (SCA (NSW)) and must abide by their Code of Conduct.

The SCA Ethics Committee (ethics.nsw@stratacommunity.org.au) is prepared to investigate the professional misconduct of their member Raine & Horne Strata Epping if the Executive Committee approves such action.

Allowing a professional organization such as the SCA to run their investigation would achieve several things:

* Independent verification of compliance with their Code of Ethics;

* Confirmation if the services provided by Raine & Horne Strata Epping are indeed as good as members of the EC claim;

* An opportunity to permanently discredit me (Lot 158) if I am proven to be "wrong".

* No cost to owners corporation for this investigation. The SCA conducts their checks without invoicing our complex.

The following breaches of the SCA Code of Ethics by Raine & Horne Strata Epping need to be verified:

Failure to comply with the SCA 1.2 i.

Failure to comply with the SCA 1.3 i. to xi. inclusive Failure to comply with the SCA 2.1 e.

Failure to comply with the SCA 2.1 j.

Discuss the approval to allow the SCA to conduct Raine & Horne Strata Epping compliance with their Code of Ethics and justify the decision why it should or should not proceed.

2. The latest spreadsheet of expenses for water and gas reimbursements for SOME townhouse owners highlights very serious discrepancies in "equitable" share of costs. Some examples:

One townhouse owner claimed $1,915.46 in FY 2013 so far;

Another owner claimed $1,009.89 in FY 2013 so far;

Another owner claimed $964.89 in FY 2013 so far;

Another owner claimed $917.21 in FY 2013 so far;

Another owner claimed $854.57 in FY 2013 so far;

Another owner claimed $644.07 in FY 2013 so far;

Another owner claimed $389.54 in FY 2013 so far;

Another owner claimed $266.78 in FY 2013 so far;

Another owner claimed $242.91 in FY 2013 so far.

and so on.

The short summary is enclosed herewith.

So far, in FY 2013, 17 townhouse owners, who represent 7.80% of the total owners, added 13.85% to the cost for water and gas expenses that the whole owners corporation (218 owners) made together!

For shared water and gas expenses that are collected from shared metering (without townhouses), average owner in the complex incurred costs of $375.49, whilst the townhouse owners who claim personal water and gas expenses incurred cost of $666.90 on average.

Maybe the EC would like to analyze this, or pretend that there is no issue for the last 14 years?

3. On 19 April 2013 the submission by the Solicitor Mr. Adrian Mueller and the EC was sent to the CTTT via courier. It incurred cost of $851.56 (enclosed document proves it). A small document of around 70 pages the courier company charged excessive fee.

Who approved it and with what justification such expense was authorized (a simple drive to the city and delivery in person was very convenient and easy)?

4. Strata Manager charged owners corporation $450.00 for attending the CTTT Hearing on 10 May 2013, in spite of not being active part of the case (only in audience).

Who approved and authorized this expense and why the members of the EC, who were supposed and asked to attend, declined to do so?

5. Eight months after the AGM 2012, the Special By-Laws that were "legally approved" at the meeting were registered with the LPI on 3 June 2013.

I requested access to the by-laws on many occasions.

As typical, the Strata Manager and the EC had no responses.

It is duty of the Strata Manager to provide it to all owners FREE of CHARGE. Please comply with the law now.
