Hello Gary,

The Adjudicator's request at the CTTT is now ready. For the sake of all owners in the complex, I think everybody needs to support free access to facts in accordance with laws.

In the meantime, one more item requires our attention.

In accordance with:

NSW Strata Schemes Management Act 1996

Division 2 Members and office holders of the executive committee

22 What are the functions of the secretary of an owners corporation?

(a) to prepare and distribute minutes of meetings of the owners corporation and submit a motion for confirmation of the minutes of any meeting of the owners corporation at the next such meeting,

(c) to enable the inspection of documents on behalf of the owners corporation in accordance with section 108,

(d) to answer communications addressed to the owners corporation

... Please forward my request to Secretary of the committee to provide copies of the CURRENT contracts for:

a) Managing Agent

b) Maintenance (Garden, Pool, Complex)

Interesting issue has slipped attention of owners at AGM 2011:

1. In this AGM 2011 address, EC stated:

The committee is concerned that since the sale of the Raine & Horne Strata business to BCS and the departure of John Fry from the business that service levels have dropped. Alternative arrangements may have to be considered in the coming year. Owners are not asked to vote on this matter at this AGM but should be aware of the outgoing committee's concern.

2. Then, just one week later, the AGM 2011 addendum stated the following (therefore finalizing the contract even before the AGM happened):

Discussions have taken place with senior executives of the managing agent and a reduction in fees for the coming year has been agreed as part of a package of measures being worked out to help resolve service levels problems experienced recently. If these measures are unsuccessful we can revisit the issue at a later date. The current contract therefore remains in place, with altered fees.

I am very interested to see full details of these contracts, including penalties for early cancellations, full cost of services, how will owners or their representatives measure satisfaction of services offered, and so on.
