Hello,

Note that I submitted a request and evidence for summarily dismissal of SCS 12/32675 today.

The evidence was presented to CTTT. My argument is that is not even necessary to have yet another costly Hearing in May 2013 because the EC, Strata Manager and the Solicitor failed to provide authoritative evidence about procedures in relation to the engagement of the Solicitor.

But, to ensure that no strange games occur, I will also present a 4-page response and the evidence by 28 April 2013 as per Tribunal orders on 15 April 2013. I will leave nothing to the chance.

In the meantime, for a different reason I request YOUR OFFICIAL RESPONSE (as a supposed Secretary of the EC) in accordance with:

NSW Strata Schemes Management Act 1996

Division 2 – Members and office holders of the executive committee

22 What are the functions of the secretary of an owners corporation?

(a) to prepare and distribute minutes of meetings of the owners corporation and submit a motion for confirmation of the minutes of any meeting of the owners corporation at the next such meeting,

(c) to enable the inspection of documents on behalf of the owners corporation in accordance with section 108,

(d) to answer communications addressed to the owners corporation

a) Confirmation that the Strata Manager is an official Treasurer, Secretary and the Chairperson of the EC too. That is what the Solicitor's response to the CTTT claims this week.

b) Who signed off the minutes of the unapproved paper EC meeting supposedly held on 19 April 2013? The signature of the Chairperson is illegible.

One of the amazing bloopers with the minutes of the EC meeting on 19 April 2013 is the fact that eight EC members signed the voting papers which contain the date of the meeting 26 April 2013. It is physically IMPOSSIBLE to publish the minutes of this EC meeting one week before it actually happens. Our current science does not know how to do it. So, the minutes of the EC meeting scheduled in the future (will happen on Friday, 26 April 2013) were "approved" and published to the CTTT and me on 19 April 2013. In my submission to the CTTT today I congratulate you on achieving something that even feature films like "Back to the Future" would be proud of.
