As I still have not received documents as presribed by SSMA 1996 S108, including full financial statements for FY 2014, one of the actions I am taking is writing a book. If anyone is willing to offer ANY file to counter my claims and evidence, I will be happy to listen.

Section 316 of the Crimes Act 1900 (NSW) makes the knowing concealment of information relating to a "serious indictable offence" a crime punishable by up to 2 years imprisonment.

Section 4 of that Act defines "serious indictable offence" to mean an indictable offence that is punishable by imprisonment for life or for a term of 5 years or more. Subject to certain exclusions this generally includes the fraud offences in Part 4AA of that Act as well as stealing and similar offences in Part 4.

Section 316(1) provides:

(1) If a person has committed a serious indictable offence and another person who knows or believes that the offence has been committed and that he or she has information which might be of material assistance in securing the apprehension of the offender or the prosecution or conviction of the offender for it fails without reasonable excuse to bring that information to the attention of a member of the Police Force or other appropriate authority, that other person is liable to imprisonment for 2 years.

There are various other relevant provisions.

I am not prepared to get hit by huge costs of repairs in next several years due to delayed management in the complex.

One million in the bank is not much when all undeclared projects are accounted for.

In it, BCS was quoted as follows:

Records kept electronically. Charged for printing out documents off computer. Not all scanned in. Cannot guarantee all is available. Computer issues – logged off/logging on for additional searches. Time involved.

c) Facebook comment to Strata Community Australia, which is supposed to investigate professionalism of its members:

The owner said:

I have no rating objectives from Strata Community Australia, but I need to write a complaint about BCS Australia, I wrote directly to one of your directors MR Greg Haywood. My situation is even worse now after I wrote the letter. Could you please direct my complaint to the proper address. I am not in a position to hire a lawyer, but you would agree that yearly levies of 270k per year for three lot owners is a something from a fantasy world. I need your prompt recommendation of how to stop the machine going, our AGM and EGM meeting is on the 9th of July. Your site has no place for any messages from the public. It looks and feels very self-congratulating.

Strata Community Australia NSW declined to examine BCS on grounds that they did not have approval by the Executive Committee to proceed (should police or other law-enforcement agencies stop with their work if criminals complained they did not want to be investigated!). Same happened to our files. They "seated on" files for three months and then returned them without action.

d) BCS involvement in wasting around $100,000.00 in legal fess from common funds of owners corporation in World Towers in Sydney fighting builder Meriton Apartments for poor maintenance in 2012. Owners corporation terminated contract with BCS.

More than that, thanks to community sharing, the attached document contains horrific scale of investigation in that large complex and there are number of similarities to Macquarie Gardens (see BCS-Large-Strata-Scheme-in-Sydney-Contract-Terminated-by-Owners-Corporation-26Sep2012.pdf).
