Undeniable evidence that members of the Executive Committee and BCS Strata Management not only knew about the defects but also chose to ignore them.

My email dated 31 July 2013.

By the way, some of external fire doors in the basement of buildings are also jamming and can only be opened half-way.

Hello,

I submit the following documents for all owners in the complex and request to be tabled at the next committee meeting.

My request complies with NSW Strata Schemes Management Act 1996, Division 2 Section 22.

a) On 6 June 2013, I submitted the request with the following subject:

SUBMISSION FOR THE CTTT CASE 12/5XXXX and GENERAL MEETING: Maintenance in the complex and compliance with the State and Federal Regulations on 6 June 2013

No response was ever received.

b) In July 2013, Eagle Fire Protection conducted a second inspection (reports for January 2013 and July 2013) are enclosed herewith.

c) Even an uneducated person can figure out that due to lack of maintenance, our cost to rectify fire protection issues increased by 30.32% in just six-month period in 2013.

As of now, Eagle Fire Protection's assessment gives total cost of $26,878.50 (GST inclusive) to rectify all issues.

d) Compliance with Fire and Safety regulations impose very stringent rules.

Fire safety is an extremely important part in the maintaining of a Strata or Community scheme. In many instances, it is one of those matters that is put into the "too hard" and "too expensive" basket, possibly putting the lives of the scheme's lot owners and visitors at risk.

The NSW Environmental Planning & Assessment Regulation 2000 requires that "the owner of a building, to which an essential fire safety measure is applicable, is required to maintain each essential fire safety measure in the building". Failure to comply with this legislation can lead to significant fines and possibly serious legal ramifications for those responsible.

We also have to comply with Work Health and Safety Regulation 2011 and NSW Strata Schemes Management Act 1996:

All owners in the complex, rightfully and legally, expect a full response from the secretary of the Executive Committee, who happens to be the Chairperson, Treasurer, and the Strata manager at the same time for SP52948 in FY 2013.
