Hello, I have to apologise for lot of emails. I wish somebody else did all this work, as they are paid for it. If there was any transparency in our strata complex, there would be no need to investigate. Strata Manager (with duties of Secretary and Treasurer of the Executive Committee in 2013 and 2014), failed to provide access to financial and accounting documents as per SSMA 1996 Section 108. Nevertheless, based on firm copies of invoices available so far, I provide listing of owners who, unfortunately, have not proved to have paid all costs as obligated. I only include overpaid details for townhouse owners in FY 2014 (1Sep2013 to 31Aug2014). Overpaid reimbursements between 6May2013 (when Special By-Law 13 was registered) and 31Aug2013 was left for EC and Strata Manager to correct before AGM2014. So far, there is absolutely no proof they did it. Add to it those owners who did not pay their levies (in each year, the typical figure is $15-20,000 in outstanding debts)... Reimbursements to selective townhouse owners between 1999 and 6May2013 paid without Special Resolution and By-Law (loss of around $160,000 in Admin Fund) were approved at EGM on 4 December 2013 without quorum, so this meeting was illegal. For more details, wait for the AGM 2014. Owners of Lot 136 and 137 reminded me about their own debt (see enclosed correspondence) and a proof of how he votes at AGMs. These are basic obligations of Secretary of the Executive Committee: STRATA SCHEMES MANAGEMENT ACT 1996 - SECT 22 What are the functions of the secretary of an owners corporation? 22 What are the functions of the secretary of an owners corporation? The functions of a secretary of an owners corporation include the following: (a) to prepare and distribute minutes of meetings of the owners corporation and submit a motion for confirmation of the minutes of any meeting of the owners corporation at the next such meeting, (b) to give on behalf of the owners corporation and of the executive committee the notices required to be given under this Act, (c) to maintain the strata roll, (d) to enable the inspection of documents on behalf of the owners corporation in accordance with section 108, (e) to answer communications addressed to the owners corporation, (f) to convene meetings of the executive committee and (apart from its first annual general meeting) of the owners corporation, (g) to attend to matters of an administrative or secretarial nature in connection with the exercise, by the owners corporation or the executive committee, of its functions. |
