I am writing in regards to TIO reference number 2014/10/03580.

Two weeks ago I initiated complaint with the TIO in regards to:

BigAir Site ID R2MAC

BigAir Group Limited (BigAir)

ABN 57 098 572 626

ACN 098 572 626

Can you please provide licensing details of BigAir Site R2MAC?

Executive summary of my TIO complaint:

BigAir Group Ltd (BigAir) and its predecessor WHome wireless service provider failed to comply with the commercial agreement with Strata Plan from April 2004 until now:

1. Have not reimbursed owners corporation an amount equal to 5% of all income twice a year.

2. Since 15 November 2013 runs the business without any legal rights as original WHome contract was cancelled by the owners corporation officially.

3. Have not paid 10% interest on lost payments to owners corporation.

4. SkyNet Global failed to ensure all required certifications were provided to the owners' representative within five business days of completion of installation.

4. Currently, BigAir is:

* Not paying for electricity usage to owners corporation;

* Not paying for renting common property in the complex. In 2010, the owners corporation rejected Optus' proposal to rent common properly for small mobile tower in amount of $22,000 per year.

* Not serving the needs of the owners (there is seemingly ONLY one owner in the complex who subscribes to BigAir services).

* Is illegally running business on the private property, in spite of clear order by the owners corporation to leave premises on 31 January 2014.

* Is seemingly running wireless service provider business to customers outside the complex, which was never approved in the original contract or at any time afterwards.

* All my attempts to communicate with BigAir representatives failed as they:

- Refuse to acknowledge that I wrote to them three times.

- Refuse to provide details of their licensing for site R2MAC (advising me to search for it myself).

- Refusing to acknowledge that they provide services to customers outside complex.

- Even engaged in providing false statements and avoiding answering direct questions.

At the same time, Strata Management Agency BCS Strata Management (now trading as BCS), which manages our complex, also refuses to co-operate and does not want to provide access to crucial documents.
