Subject: EPILOGUE - TIO Complaint 2014/10/03580 finally resolved in June 2018

To whom it may concern,

Back in 2014 I submitted a complaint to the TIO office in regards to operation of ISP BigAir in strata plan since 2004 in non-compliance with the contract and in non-compliance with owners corporation legal order to leave the complex on 31 January 2014 (legal costs were above $4,000.00).

At the time, I provided the TIO with extensive evidence and proofs.

Eventually, in spite of the original promise, the TIO office asked me to provide them with the authorization form, which BCS Strata Management and EC members refused to sign or act upon - against owners corporation decision at the general meeting.

Due to lack of action, BigAir continued to run the business without benefits to owners corporation and without reimbursing owners in any form or shape, until June 2018 (refer to attachment).

Due to my efforts, Hon Matthew Kean's (MP, Minister for Innovation and Better Regulation) ordered the Department of Fair Trading to investigate affairs in strata plan in late 2017 (one of them being the ISP business).

It is pity that your office failed to investigate the complaint in proper manner and let the illegal business operate for so long.

The settlement amount is well below the market values.

In retrospective, the TIO office could have done much more to help and had every opportunity to do so.

Sincerely,

Dear Mr. [name withheld],

I sent request for authorisation to represent owners corporation to Strata Manager and the Executive Committee last night.

Whether I am the representative, or someone else (as long as their actions are transparent and legal), it does not really matter.

Put aside all issues at the moment, the fact that nobody is willing to provide license details of BigAir's Site ID R2MAC is questionable.

a. BigAir refused to give license information. Originally, SkyNet Global did not seem to give it to owners corporation in 2004 or at any time since.

b. Strata Manager and the Executive Committee also refuse to publish the license details (if they have it at all!).

c. ACMA web site search does not show any license for BigAir at the strata complex address. I enclose herewith one of many types of searches I did at ACMA. I asked ACMA to clarify.

Regards,

Please find attached an Authorisation Form that you will need to complete in order to demonstrate you are formally authorised to represent the owners corporation involved in this matter.
