To whom it may concern,
I would like to submit the following statement in relation to Tribunal orders made on 19 of December 2012 for SCS 12/32675.
1. Respondent failed to send any information or notify me in regards to their submission. The deadline for their submission was on or before 28 of January 2013 (today).
I was not contracted via email or in any other form by this evening. I can only assume that no submission was sent by the Respondent to CTTT or myself.
2. As per Tribunal directions on the papers, I will submit my document by 21 of February 2013, in spite of not having any files from the Respondent, unless the CTTT notifies me differently.
3. I use this opportunity to advise CTTT that the owners at Macquarie Gardens are not notified about the current DFT and CTTT cases that relate to issues in the complex. The Strata Manager and the EC members avoid giving any information:
* No owner received any notification that CTTT SCS 12/32675 was re-opened and pending action;
* No owner received any notification that CTTT SCS 12/50460 was pending the DFT mediation;
In fact, 12-Folder evidence was already delivered to CTTT on 18 December 2012 and the Respondent was notified by me immediately. They did not pass that notice to other owners.
* No owner received any information that the Respondent failed to comply with CTTT orders in SCS 12/32675 three times:
CTTT Directions Hearing on 8 of August 2012
CTTT non-compliance note on 19 of September 2012
CTTT non-compliance note on 9 October 2012
* No owner received any information that the DFT case SM12/1537JR was opened and pending action before proceeding with SCS 12/50460.
The Mediation in DFT SM12/1537JR is tentatively scheduled for 31st of January 2013. At this stage, I have not received any formal confirmation about it.
* No owner received full information about the cost of involving Solicitor Mr Mueller during 2012 for SCS 12/32675.
The engagement of Solicitor was not approved or discussed by owners corporation at any general meeting so far.
Due to private commitments, I will not be available during most of February 2013.
I will organize that my submission to CTTT for SCS 12/32675 is delivered by 21 February 2013.
In the worst case, if my private schedule requires me for longer than I expected, I kindly ask CTTT to allow me to extend the deadline for my submission by one week: until 28 of February 2013. Could you please accept my request for extension of time to submit my document? I am only asking it to avoid possibility of non-compliance.
